Electronic and digital signatures: what changes in practice?

Understand signature terminology and how to assess the signing method your document needs for use in Brazil.

Start with the document, not the label

Signing online means expressing agreement through an electronic process. “Electronic signature” is an umbrella term for different mechanisms. “Digital signature” commonly highlights cryptography and certificates. Marketing language sometimes mixes these terms, but a service’s name alone does not establish which requirements a document meets.

In Brazil, Law 14,063/2020 distinguishes simple, advanced and qualified electronic signatures within its scope. This classification does not mean every online signature meets every agreement’s requirements.

What to assess before sending

Identify the document, parties, purpose and process-specific requirements. Some acts require their own formalities. Also consider how the signer will be authenticated, which records will be preserved and how the completed document will remain accessible.

A signature drawing on a screen should not be your only question. Consider the whole process: the document presented, the signers’ participation, authentication and completion records. If the required format is unclear, review the case with the responsible legal team.

How to choose a platform

For an individual, independent professional, sole proprietor or company, clarity and organization matter: sending a document, tracking outstanding signatures and finding the agreement later. Compare features actually offered by each plan without confusing delivery channels with identity verification.

Explore the Signature Platform and available plans. To understand access layers, also read about invitations, reminders and authentication. This article discusses terminology in a Brazilian context, rather than establishing the requirements for another jurisdiction.
